In news that continues to be the norm, U.S. lawmakers do not like how the FDA is regulating CBD. Surprise, surprise, right? This time, two Republican congressmen sent a letter to Robert Califf, the FDA commissioner, to voice their concerns and frustrations. While this is just the latest event in the ongoing beef between legislators and the regulatory agency, here is what is going on in the current battle.
Regulatory Uncertainty
This time around, Representatives Morgan Griffith and Brett Guthrie sent the letter to Commissioner Califf to highlight their issues with the FDA taking too long to enact CBD rules. According to Marijuana Moment, the legislators believe the FDA should have done much more since Congress passed the 2018 Farm Bill. Due to the lack of action, the reps said there are “significant marketplace disruptions and regulatory uncertainty.”
Unregulated Marketplace
While Griffith and Guthrie wrote they understood that the FDA has to do their due diligence by collecting safety data, they want the FDA to step up. They fear that the lag in action causes unintended safety issues for customers. The lawmakers said the large CBD marketplace is essentially unregulated, leaving customers at risk. As a result, they wrote that “a patchwork of state laws and regulations” must keep consumers safe but does not suffice.
Fresh, New Approach
Additionally, the legislators think that the FDA takes the wrong approach regarding penalizing companies. Griffith and Guthrie wrote that while the agency sends warning letters to companies that make unsubstantiated claims, the agency is not going far enough. They wrote the FDA should instead “establish a clear set of standards for companies to adhere to.” Consequently, the representatives say concise standards would allow companies to bring safer products to the market.
Pressing Questions
Representatives Griffith and Guthrie gave the FDA commissioner a deadline of October 17 to answer several pressing questions. The first question asks specifically what the agency has done to collect data and research. They also want answers on how the agency has worked with other federal agencies to develop a regulatory framework.
