In December 2021, a bipartisan group of lawmakers introduced the CBD Product Safety and Standardization Act. The act would force the Food and Drug Administration (FDA) to pass regulations for manufacturers concerning hemp-derived CBD in food and beverages. Regulatory Gap 
Lawmakers decided the bill was needed to “address a regulatory gap that hemp stakeholders have been pushing FDA to resolve,” according to Marijuana Moment. The legislators believe that the agency hasn’t stepped enough to ensure CBD’s safety to the masses. Although the 2018 Farm Bill legalized CBD products, there are no hard and fast rules in marketing these items. In a press release, one lawmaker wrote, “CBD products are exploding in popularity, but the lack of federal regulation surrounding them has put consumers at risk and left businesses looking for clarity.” 
Requirements Under the Bill 
The CBD Product Safety and Standardization Act would require the FDA to devise rules and allow public comment. The comment period would determine “the maximum amount of hemp-derived CBD that could be added to a food item or beverage per serving, labeling and packaging requirements.” With the bill, the rules would enable more standardization to ensure consistency and let customers know what they are getting. 
Support for the Bill 
Not only are consumers on board with the bill, but also industry groups. U.S. Hemp Roundtable and Consumer Brands Association both support the bill and want it passed. One lawmaker said, “It’s clear that this growing industry needs regulatory clarity in order to continue selling their products safely and effectively.”
