Stronger CBD Legislation in the Works

What do CBD users want? They want the market better regulated, safer, more accessible, and strengthened overall. They have been less than impressed by current U.S. law concerning CBD since laws vary from state to state. As a result, there are plenty of loopholes. However, as CBD gains popularity, lawmakers attempt to keep up with the demand by building a more robust legal framework. Here are some of the issues Congress wants to address regarding the CBD industry. 
THC Limits 
Currently, the federally allowed THC limit is 0.3%. Everyone doesn’t agree with it and wants the law changed. Lawmakers from the House Appropriations Committee are concerned that companies can be penalized because some extraction processes can temporarily increase THC levels past the limit. They point to the fact that the 2018 Farm Bill put language in place to expand the definition of hemp to prevent this issue. Consequently, they want to write new legislation to protect companies from these arbitrary rules.
Contaminated Products 
The committee is concerned that due to the growth of the CBD market, there is a chance for unscrupulous manufacturers to take advantage. Lawmakers believe these companies can produce dangerous products full of contaminants that can harm consumers. They also worry that these CBD products can contain parts of the cannabis plant that aren’t legally allowed.
CBD Marketing 
Also, the House wants CBD marketing addressed, including providing businesses with enhanced guidance. They want to ensure that companies aren’t making false and misleading claims or incorrectly labeling products. While many have targeted the FDA for being too slow concerning CBD marketing regulation, the committee pointed out that it takes time and is multi-faceted. The lawmakers said the FDA has looked into “research, requests for data, consumer education, issuance of guidance and policy” around developing appropriate guidelines. While the FDA often sends warning letters to companies that break marketing rules, the committee wants the agency to take more action.
